Kompromisaftale i stand om organiske
persistente miljøgifte

Europa-Parlamentet vedtog d. 26. februar en betænkning

om Kommissionens forslag2) til en forordning om persistente organiske miljøgifte (POP’er2))3), som Pernille Frahm har været ordfører for. Forslaget blev bakket op af alle Parlamentets politiske grupper. Inden afstemningen var det nemlig lykkedes Parlamentet at opnå enighed med Rådet om et kompromisforslag, der betyder, at forslaget ikke behøver at gå videre til andenbehandling. Formålet med forordningen er at forbyde, udfase og begrænse fremstilling og anvendelse af en række stoffer, som indeholder POP’er. I den tekst Rådet og Parlamentet blev enige om, skal alle eksisterende lagre, der indeholder de forbudte stoffer4), som er omfattet af forslaget, behandles som affald. Der er derfor fastsat et kompliceret sæt regler for bortskaffelse og nyttegørelse af dette affald. Desuden er stofferne HCH og Lindan kommet på forslagets bilagsliste over forbudte stoffer, dog er der medtaget en række undtagelser. Et andet redskab, der er gjort flittigt brug af i forordningen, er en række forskellige tidsfrister for, hvornår f.eks. stoffer, ordninger og undtagelser skal revurderes eller ophøre. Tidsfristerne strækker sig fra udgangen af 2005 til 1. januar 2014.

Forslaget skal sikre, at EU på fællesskabsplan har gennemført en lovgivning, der svarer til bestemmelserne i to internationale aftaler nemlig: Stokholm-konventionen om persistente organiske miljøgifte og LRTAP protokollen om grænseoverskridende luftforurening over store afstande i forbindelse med POP’er 5).

Affaldshåndtering

I aftalen, Europa-Parlamentet har indgået med Rådet, er der oprettet to bilag om affald til reglerne om affaldshåndtering (art. 7), nemlig bilaget om "Affaldshåndtering6)" og "Affaldsforvaltning7)". Ifølge artikel 7 kan affald, der indeholder stoffer, som er med på bilagslisten om "affaldshåndtering", bortskaffes eller nyttiggøres. Men det skal ske på en sådan måde, at POP-indholdet destrueres eller omdannes irreversibelt, sådan at restaffaldet og udslip ikke udviser egenskaber, der er karakteristiske for POP’er. Bortskaffelsen eller nyttiggørelsen af stofferne på denne liste skal ske efter reglerne for affaldsforvaltning. Det betyder, at affaldet enten skal gennem en fysisk-kemisk behandling, forbrænding på landjorden eller som hovedanvendelse som brændsel eller andre midler til energiforsamling.

Ingen regel uden undtagelser

Der er dog indført flere undtagelser. For det første kan affald med stoffer, som er opført på listen om affaldshåndtering, bortskaffes eller nyttiggøres på anden måde, så længe det overholder anden fællesskabslovgivning samt nogle maksimale grænseværdier for stoffernes koncentration i affaldet. Koncentrationsværdierne skal dog først fastsættes inden udgangen af 2005 8). Indtil da er det op til medlemsstaterne selv at fastsætte grænserne.

For det andet kan en medlemsstats myndighed i særlige tilfælde give tilladelse til, at affald, der er opført i afsnit 2 på listen om "affaldsforvaltning", behandles efter en særlig procedure, hvis det er påvist, at direktivets øvrige bestemmelser om behandling af affaldet ikke er mulige at gennemføre eller ikke er den miljømæssigt fortrukne løsning. I sådanne tilfælde er det muligt at deponere affaldet permanent i bl.a. sikker dyb undergrund, saltminer samt på lossepladser for farligt affald. De øvrige medlemstater skal dog underrettes om sådanne tilfælde, og denne undtagelsesregel skal tages op til fornyet vurdering inden udgangen af 2009.

I den forbindelse havde Parlamentets miljøudvalg, med Pernille Frahm i spidsen, oprindeligt krævet, at permanent oplagring ikke skulle tillades, ligegyldigt under hvilken form. Men det lykkedes ikke for Parlamentets miljøudvalg at få indført et forbud mod opbevaring af affaldsstoffer i kompromisaftalen med Rådet.

Desuden spiller Europa-Parlamentet spiller en central rolle i forbindelse med fastsættelsen af denne procedure. HCH – Lindan og DDT

Hvad angår HCH og Lindan, så er stofferne i Rådets og Parlamentets kompromistekst medtaget på listen over forbudte stoffer. Disse var i Kommissionens forslag opført på listen over stoffer med begrænsninger. I miljøudvalgets forslag var bilaget med begrænsninger slettet, fordi stofferne på listen var flyttet til listen over forbudte stoffer. Men i aftalen med Rådet er bilaget medtaget uden dog at have nogle stoffer opført. På den forbudte liste er der opremset en række undtagelser for, hvor HCH og Lindan fortsat kan bruges, hvis en medlemsstat tillader det. Indtil 1. september 2009 drejer det sig om professionel og industriel behandling af tømmer og træstammer samt indendørs brug i industrien og hjemmet. Indtil udgangen af 2007 drejer det sig om "teknisk HCH" til brug som mellemprodukt ved fremstilling af kemiske produkter samt et andet teknisk HCH middel til anvendelse som insektbekæmpelsesmiddel.

Stoffet DDT er også på den forbudte liste. Men som følge af kompromisaftalen kan medlemsstaterne undtagelsesvist tillade den eksisterende fremstilling og anvendelse af DDT, som et mellemprodukt i et lukket system på et afgrænset område, i forbindelse med fremstilling af "dicofol" indtil udgangen af 2013. Denne undtagelse skal dog revideres inden udgangen af 2008 i forbindelse med evalueringen af et direktiv om markedsføring af plantebeskyttelsesmidler.

Retsgrundlaget

Rådet og Parlamentet er blevet enige om at retsgrundlaget for forordningen skal være artikel 175 stk. 1 om gennemførslen af fællesskabets miljøpolitik. Kommissionen havde foreslået et dobbelt retsgrundlag, hvor artikel 175 stk. 1. skulle dække miljøaspekterne, og artikel 95 stk. 1 skulle dække forordningens bestemmelser vedrørende det indre markeds oprettelse og funktion. Under debatten fastholdt Kommissæren med ansvar for konkurrence, Mario Monti, at Kommissionen ikke kan støtte kun at have artikel 175 stk. 1 som retsgrundlag. Han begrundede det med, at det er hensigten, at indholdet af forordningen skal indarbejdes i den nye kemikalielovgivning (Reach), som udelukkende er baseret på retsgrundlaget om det indre marked. Hvis retsgrundlaget er forskelligt, kan det få betydning for medlemsstaternes mulighed for at vedtage mere omfattende regler, sagde han. Han understregede desuden, at bestemmelserne i forslagets artikel 3 og 4 altovervejende havde betydning for det indre marked. Europa-Parlamentets miljøudvalg havde holdt hårdt på, at retsgrundlaget kun blev traktatens bestemmelser om miljø og folkesundhed og ikke det indre marked, mens Europa-Parlamentets retsudvalg i dets udtalelse støttede Kommissionens forslag om det dobbelte retsgrundlag.

Utilsigtede biprodukter

Parlamentet og Rådet er blevet enige om en hensigtserklæring om, at utilsigtede biprodukter fra industrielle processer skal nedbringes så hurtigt som muligt og bringes til ophør, når det er muligt. De er også enige om, at der bør udarbejdes nationale handlingsplaner og Kommissionen og medlemsstaterne skal i den forbindelse etablere programmer og ordninger for overvågningsdata om tilstedeværelsen af dioxiner, furaner og PCB i miljøet. Der skal i den forbindelse tages hensyn til udviklingen i forbindelse med FN/ECE-protokollen og Stokholm-konventionen.

Ratifikation i medlemsstaterne

Ifølge listerne over hvilke medlemsstater der har ratificeret henholdsvis konventionen og protokollen, mangler en del lande stadig at ratificere protokollen og konventionen. For protokollens vedkommende mangler 12 ud af 25 EU-medlemsstater at ratificere den. Med hensyn til konventionen har kun 10 ud af EU-25 ratificeret den.

Annex V to the ANNEX

WASTE MANAGEMENT

Part 1 Disposal and recovery under Article 7(1)

The following disposal and recovery operations, as provided for in Annex IIA and IIB of Directive 75/442/EEC as amended, are permitted for the purposes of Article 7(1) when applied in such a way as to ensure that the persistent organic pollutant content is destroyed or irreversibly transformed

D9 Physico-chemical treatment,

D10 Incineration on land, and

R1 Use principally as a fuel or other means to generate energy, excluding waste containing PCBs.

Pre-treatment operation prior to destruction or irreversible transformation pursuant to this Part of this Annex may be performed, provided that a substance listed in Annex IV that is isolated from the waste during the pre-treatment is subsequently disposed of in accordance with this Part of this Annex. In addition, repackaging temporary storage operation may be performed prior to such pre-treatment or prior to destruction or irreversible transformation pursuant to this part of this Annex.
