I forbindelse med det kommende rådsmøde (almindelige anliggender og eksterne forbindelser), herunder møde mellem forsvarsministrene den 18.-19. november 2002 vedlægges Formandskabets udkast til kommenteret dagsorden vedrørende dagsordenens punkt 3 om forberedelse af Det Europæiske Råds møde i København.

European Council (12-13 December 2002) - Annotated draft agenda |
According to the Seville European Council Conclusions, the General Affairs and External Relations Council, acting on a presidency proposal, shall draw up an annotated draft agenda at least four weeks before the meeting of the European Council. The agenda should distinguish between items to be approved or endorsed without debate, items for discussions with a view to political guidelines, items for discussions with a view to decisions as well as items for discussion but not intended to be the subject of conclusions.
Against this background the Presidency submits the following annotated draft agenda. As discussions on the issues mentioned are still ongoing the draft agenda does not at this stage distinguish between the various categories of items. This will become clearer in the process up to the GAERC on 9 and 10 December.

The Presidency intends to limit the agenda to the following items:
I. Enlargement
II. Functioning of the Council in view of enlargement
The European Council will also hear a progress report on work in the European Convention from its President, Mr. Valéry Giscard d'Estaing.
The meeting will be preceded by an exposé by the President of the European Parliament, Mr. Pat Cox, followed by an exchange of views.
I. ENLARGEMENT
In accordance with the Brussels European Council Conclusions the European Council is expected:
- to take the necessary decisions and conclude the accession negotiations with the 10 candidate states identified at the October European Council with a view to signing the Accession Treaty in Athens in April 2003;
- to take the necessary decisions concerning first of all detailed roadmaps, including timetables, and increased pre-accession assistance in order to advance the accession process with Bulgaria and Romania;
- to decide on the next stage of Turkey's candidature.
II. FUNCTIONING OF THE COUNCIL IN VIEW OF ENLARGEMENT
In accordance with the Seville European Council conclusions, the European Council will be presented with:
- an initial report from the Presidency on the Presidency of the Union;
- an initial report from the Presidency on the use of languages in the context of an enlarged Union and practical means of improving the present situation without endangering basic principles.

ANNEX: SUBJECTS ON WHICH REPORTS WILL BE PUT FORWARD IN ACCORDANCE WITH PREVIOUS EUROPEAN COUNCIL DECISIONS
- European Security and Defence Policy
The report will cover the issues set out in paragraphs 11 to 16 of the Seville European Council conclusions (military and civilian capabilities, EU police mission in Bosnia-Herzegovina, possible take-over of Amber Fox, fight against terrorism, etc ...).
(The European Council receives a Presidency progress report on ESDP at six-monthly intervals. The last one was submitted to the Seville European Council.)
- Drugs
The report will review implementation of the EU's Action Plan on Drugs (2000-2004) endorsed at the Feira European Council and set priorities for the remaining period of the plan.
(Provision for a mid-term review is made in the Action Plan itself. The Presidency will report on the basis of communication from the Commission.)
- Taxation
The report will describe progress on the tax package, which various European Councils have stressed should be finally adopted before the end of 2002.
(It was agreed at the Göteborg European Council that the Council should regularly inform the European Council on progress of work.)
- State aids
The Commission is expected to report to the European Council on the progress of work on the guidelines for state aids.
(Remit from the Seville European Council, given in connection with the question of services of general economic interest.)
- 3G telecommunications
The Commission is expected to report to the European Council on the barriers to the roll-out of third-generation mobile telecommunications networks and services.
(Remit from the Seville European Council in response to a first report on this subject from the Commission.)

Work on some of the questions listed above has already started and will continue in the appropriate Working Parties and in COREPER. A draft report on the Presidency of the Union is being submitted to this session of the Council. Final preparation of the European Council will be in the General Affairs and External Relations Council on 9-10 December.
