Til underretning for Folketingets Europaudvalg vedlægges Fødevareministeriets grundnotat vedrørende forslag til Kommissionens beslutning om fastlæggelse af hygiejnebetingelser og udstedelse af hygiejnecertifikat for import af konsumæg fra tredjelande.

Resumé

Forslaget fastlægger hygiejnebetingelser for import af konsumæg til direkte konsum fra tredjelande, herunder modellen for det sundhedscertifikat, der skal ledsage kosumæg fra tredjelande til Fællesskabet. Betingelserne omfatter såvel opbevarings- som transportforhold samt mærkning.

Forslaget skønnes ikke at berøre beskyttelsesniveauet i Danmark og i EU.

Baggrund

Kommissionen har den 21. november 2000 ved SANCO/3105/2000 af 18. oktober. 2000 fremlagt forslag til Kommissionens beslutning om hygiejnebetingelser og udstedelse af hygiejnecertifikat for import af konsumæg fra tredjelande.

Forslaget er fremsat med hjemmel i artikel 10 i Rådets direktiv nr. 92/118/EØF.

Forslaget behandles i en III b-procedure i Den Stående Veterinærkomité. Hvis der er kvalificeret flertal, udsteder Kommissionen beslutningen. Opnås der ikke kvalificeret flertal, forelægger Kommissionen sagen for Rådet, der kan forkaste forslaget med simpelt flertal eller kan vedtage forslaget uændret med kvalificeret flertal eller ændre det med enstemmighed. Handler Rådet ikke inden en frist på 15 d age, kan Kommissionen udstede beslutningen.

Nærheds- og proportionalitetsprincippet

Kommissionen har ikke redegjort for nærheds- og proportionalitetsprincippet, da der er tale om gennemførelsesbestemmelser til en allerede vedtaget retsakt.

Det fremgår af forslaget, at der skal fastsættes særlige betingelser for import af konsumæg til Fællesskabet, og at disse betingelser ikke bør være mindre strenge, end dem der er fastsat i fællesskabsreglerne for afsætning af konsumæg i Fællesskabet.

 

Formål og indhold

Formålet med forslaget er, at fastsætte særlige betingelser for import af konsumæg til Fællesskabet.

Forslaget fastsætter betingelserne for import af konsumæg til Fællesskabet, herunder modellen af det certifikat, der skal ledsage konsumæg fra tredjelande til Fællesskabet.

Forslaget omfatter alene konsumæg til direkte konsum, men ikke konsumæg, der skal anvendes til fremstilling af ægprodukter.

Æg skal i tiden, fra de forlader producentens lokaler, til de importeres, holdes tørre og beskyttet mod direkte sollys og skal helst opbevares og transporteres ved konstant temperatur.

Emballagen skal for klasse A-æg mærkes med pakkedatoen og datoen for mindste holdbarhed efterfulgt af anbefalede opbevaringsbetingelser. Emballagen for æg i andre klasser skal mærkes med pakkedatoen.

I henhold til forslaget skal reglerne træde i kraft den 1. januar 2001. Ved telefonisk samtale med Kommissionen den 6. december 2000 er det imidlertid oplyst, at ikrafttrædelse pr. 1. januar 2001 ikke er praktisk muligt.

Udtalelse

Europa-Parlamentet skal ikke udtale sig.

Gældende dansk ret

Bestemmelserne om indførsel af hønseæg fra tredjelande er reguleret i bekendtgørelse nr. 723 af 25. juli 2000 om veterinærkontrol ved indførsel af animalske fødevarer.

Konsekvenser

Vedtagelse af forslaget kræver ingen lovændring, og kan implementeres ved ændring af bekendtgørelse nr. 723 af 25. juli 2000 om veterinærkontrol ved indførsel af animalske fødevarer.

Vedtagelse af forslaget har ingen statsfinancielle konsekvenser.

Vedtagelse af beslutningen skønnes ikke at berøre beskyttelsesniveauet i Danmark.

Høring

§2-udvalget (landbrug) og Det Rådgivende Fødevareudvalg vil blive hørt om forslaget. Forslaget har endvidere været i høring i en bredere høringskreds.

Den Danske Dyrlægeforening anfører, at der bør fastlægges temperaturkrav for opbevaring af æg, og at der bør gives oplysninger om besætningernes sundhedstilstand- specielt i relation til zoonotiske og anmeldelsespligtige sygdomme.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 92/118/EEC of 17 December 1992, laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A(I) to Directive 89/662/EEC and, as regards pathogens, to Directive 90/425/EEC, and in particular Article 10 thereof,

Whereas:

Specific conditions must be established for the importation into the Community of eggs intended for human consumption;

These conditions should not be less stringent than those laid down in Council Decision 94/371/EC laying down specific public health conditions for the putting on the market of certain types of eggs;

These conditions must be without prejudice to the provisions of Council Regulation (EEC) N° 1907/90 of 26 June 1990 on certain marketing standards for eggs, as last amended by Regulation (EC) N° 3117/94, and of Commission Regulation (EEC) N° 1274/91 of 15 May 1991 introducing detailed rules for implementing Regulation (EEC) N° 1274/91 of 15 May 1991 introducing detailed rules for implementing Regulation (EEC) N° 1907/90 on certain marketing standards for eggs, as last amended by Regulatio n (EC) N° 786/95;

Commission Decision 95/168/EC has laid down requirements for checking for salmonella in respect of the export to Finland and Sweden of certain types of eggs intended for human consumption;

A form of public health certificate must be established, to be signed by an official veterinarian, to certify that the eggs fulfil the requirements laid down in this Decision;

In addition, where it is possible to recognise conditions offering equivalent guarantees, a third country may submit a proposal for such recognition to the Commission for appropriate consideration;

The measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee,

HAS ADOPTED THIS DECISION:

Article 1

1. This Decision lays down the public health conditions for the importation of eggs intended for human consumption.
1. The provisions of Article 1 of Council Decision 94/371/EC apply for the purposes of this Decision.
1. This Decision applies without prejudice to the provisions of Council Regulation (EEC) N° 1907/90 of 26 June 1990 on certain marketing standards for eggs, and of Commission Regulation (EEC) N° 1274/91 of 15 May 1991 introducing detailed rules for implementing Regulation (EEC) N° 1907/90.

Article 2

The importation of eggs for human consumption is subject to the following conditions:

1. At the producer{{PU2}}s premises and until importation, they have been kept dry, out of direct sunshine and have been stored and transported at a preferably constant temperature;

2. the date of packing and the date of minimum durability according the requirements laid down on article 3, paragraphs 1 and 2 of Council Decision 94/371/EC, followed by appropriate storage recommendations, for grade A eggs, and the packing date for eggs of other grades, are printed on the packaging.

Article 3

1. Each consignment of eggs intended for human consumption shall be accompanied by an original, numbered public health certificate, completed, signed and dated, composed of a single sheet and conforming to the model laid down in the Annex.

2. The certificate shall be drawn up in at least one of the official languages of the Member State of introduction into the Community.

Article 4

This Decision shall apply from 1 January 2001

This Decision is addressed to the Member States.
